When am I able to upgrade as I am having issues with my current phone ?

You can upgrade whenever you like, just pay off your tab first and you cab get a new phone from Koodo. Or just pay for it outright. Or buy it anywhere and just insert your sim. It's your choice.

Hey Al, Chad is right! You can get a new phone with the methods he mentioned above! Are you still within the one year of your phone purchase?  If so, you are still eligible to use the warranty to get it checked out (unless if your phone has any physical/water damage).  You can find out more information about your phone's warranty here http://koo.do/Kwarranty .
