I then did a factory reset inside the settings but it still did the same, afterwards I then did a hard reset through recovery mode. my questions are what do i do now, it is under guarantee but I know in quebec city their are none left. do you send me a replacement phone and I return this one? extremely disapointed with this

You have 15 days to return the phone. Unfortunately it has to be done where you purchased the phone, so keep checking with them if they have any more available. If after 13-14 days they still don't have any, you can either return it and get a refund or send it off for warranty work.
